The national nightmare that is the Obama administration will soon be over, and the people who made it a nightmare still have pens and phones. From Executive Amnesty to the ad-hoc to the Obama’s administration’s effort to stifle energy exploration and usage, regulatory overreach has been the hallmark of the Obama administration.

The problems with the proposed regulation are many. The IRS has proven time and time again that they are incapable of protecting taxpayer information that is provided to them.

If we are too comfortable or otherwise engaged to “institute new Government,” might it be possible to at least return to the Constitutional limits upon the present one? If so, how can we go about it? Should we pass a law that says, “The Federal Government must abide by the Constitution” and then wait for the Supreme Court to interpret that to mean “The Federal Government can do whatever it pleases”?

Regulations should not trap and force needless expenses on consumers. The next time you find yourself paying $114 for a visit just to renew your prescription or purchasing contacts in bulk before your prescription expires, remember that this experience is the fault of Congress.

Current funding for the fiscal year expires on December 11. Kicking funding questions into 2015 would maximize the incoming Republican majority’s ability to make an immediate impact, and deny outgoing Senate Majority Leader Harry Reid (D-Nev.) a seat at the table. Here are five defund items that we believe Congress should pursue immediately.

President Ronald Reagan famously said, “Personnel is policy,” and not surprisingly, he was 100 percent right. That’s why Americans for Limited Government urged Senators Jon Tester to oppose the nomination of Patricia Smith to the office of Solicitor of the Department of Labor. As the Solicitor Patricia Smith approves every single regulation that goes through the Department. This makes her one of the most powerful people in D.C. when it comes to labor laws like the one that was proposed that would have greatly restricted the ability of young people to participate in many normal farm activities, threatening the way of life in rural America.

A lot of the RINOs here in South Dakota (including some that never use their name when leaving their liberal comments here and there) have been squawking about various individuals and groups who have been exposing the liberal votes and actions of RINOs in South Dakota government who masquerade as Republicans. A recent Wall Street Journal article discusses how homosexual activists use government regulation of “free” speech to punish and intimidate people for opposing their agenda, and it sheds some important light on the “Republican Civil War” going on in South Dakota.

California has the ninth largest economy in the world. Once booming with private corporations, agriculturally rich farmlands and tourists, the state is now losing businesses, much-needed food crops and even vacationers. How did the state that all other states sought to emulate fall to the bottom? Along with pristine beaches and beautiful weather, California also has a tax base unfriendly to businesses and those with wealth; it has a rampant environmental movement destroying communities and industries and caters to and favors the public sector union workforce so much so you’d think the state was on a mission to commit economic suicide.

So much for the separation of powers. Thanks to federal court rulings, even if Mitt Romney prevails in Nov., he will be hard-pressed to unilaterally rein in regulatory overreach by the Environmental Protection Agency (EPA). However, no agency of government should be bigger than the President of the United States and the members of Congress who are elected by the people.

In the 1850s droves of gold-hunters hoping to make it rich rushed into what would later be established as the Golden State. The pristine beaches, vast mountains and plenty of opportunity persuaded some to stay in the state. But now, California is facing a different kind of rush—one that is causing people to pick up and leave.
