LaVoy Finicum, Ammon Bundy and Restoring Liberty

lavoy_finicum_shootingThis week on my speaking tour in Northern California I met many godly patriots who are teaching the Biblical view of Law and government with the materials we have developed at IOTC. There are exciting developments taking place in that area. At one event I had the privilege to meet and share the platform with the widow of LaVoy Finicum, the man murdered by the Oregon State Police and the FBI. It was an honor to be with our Northern California Chapter Leader Janet Collins and a sobering reminder of what happens when tyranny prevails. This week there was a victory for the others in that police stop who were not murdered but have sat in jail since February of this year. You may recall Joe and I have the privilege of traveling to Burns and teaching the Biblical principles of Law and Government on February 11th just as the standoff ended. Well this Thursday the jury acquitted 7 of them of all charges and some of them have been set free, praise God.

There was a scene in the Courtroom as Ammon Bundy’s attorney Marcus Mumford made an impassioned plea to immediately release his client as the jury had acquitted him. The response of the Federal marshal was parallel to the murder of LaVoy Finicum, completely out of control use of force by Federal thugs who do not respect the rule of Law nor follow their oath of office. And God will judge them for this violation of their oath. They surrounded Marcus Mumford, and in spite of the judge’s order to stand down, they would not, they threw Ammon’s attorney down, pinning him to the ground, repeatedly tazing him and then arresting him – all because he with passion called for the immediate release of his client! Eight marshals twisting his legs throwing him on the ground and they shooting him repeatedly with, 50,000 volts. But the way the Washington Post reported last November 26, that taser used by the police are killing on average one person each week in America. And only one such incident in 2015 resulted in the policemen being indicted.

Well, the judge would not release Ammon because he still faces charges related to the defense of the Bundy ranch from the Federal thugs in Nevada in 2014. What ever happened to innocent until proven guilty and the right to be free on bond until the trial? Outrage upon outrage by our tyrannical masters from the corrupt sewer known as Washington, D.C.

Shawna Cox one of the defendants said she wept when she heard the words not guilty. “I don’t know if the government heard us but I know the jurors knew it and they felt it, and that’s why we were acquitted.” So the jury did what a true Constitutional jurors are supposed to do, as an independent entity, in fact as the fourth branch of government judge the law and the facts, determine if the governments actions against law abiding citizens is just or not.

This what happens when citizens fulfill the God ordained function -justice prevails. It we are May elected and appointed officials violating their oath of office because they have no fear of God in their hearts. Cultivating a fear of God is what we desperately need in America today. We do that by making true disciples of Jesus Christ.

Our Lord clearly instructed us just before He ascended to heaven what exactly was the commission for His followers here on earth. “And Jesus came and spake unto them, saying, All power is given unto me in heaven and in earth.

Go ye therefore, and teach all nations, baptizing them in the name of the Father, and of the Son, and of the Holy Ghost: Teaching them to observe all things whatsoever I have commanded you: and, lo, I am with you alway, even unto the end of the world. Amen.” Matthew 28:18-20

“The response of the Federal marshal was parallel to the murder of LaVoy Finicum, ”

Lavoy was not murdered. He made a bad decision. He should have stopped at the roadblock and surrendered.

“Surrender” implies that you’re already a criminal. Was he tried and convicted without due process?

      • TNUGA

“”Surrender” implies that you’re already a criminal. ”

No, as used in my statement, it means “to give (oneself) up, as to the police” or to submit to authority. When law enforcement stops you and says “you are under arrest,” you are required by law to submit to their authority.

Fleeing from such an arrest is a felony itself in most states, so when Lavoy drove away from the first stop, he committed a crime with law enforcement as witnesses. Look it up!

        • Thisoldspouse

No, a law enforcement officer cannot, on a whim, just put someone under arrest without a specific, citable law being violated in his presence, or specific probably cause that a crime has been committed being apparent. You are speaking to a former law enforcement officer who knows the constraints under which peace officers operate.

I can’t speak for most states, but in Texas, which has robust law enforcement powers in its statues, evading arrest is no felony unless others are injured or placed in imminent danger of injury in the commission of fleeing, or the actor is a repeat offender. I cannot imagine very many states being stricter than that.

“No, a law enforcement officer cannot, on a whim, just put someone under arrest without a specific, citable law being violated in his presence, or specific probably cause that a crime has been committed being apparent.”

What I said there was that when he fled, he committed a crime in the presence of law enforcement. BTW, they did not stop him “on a whim,” a federal judge had singed a criminal complaint that day.

The bottom line is that fleeing lawful arrest in Oregon is a Felony. Here is the Oregon law regarding fleeing or attempting to elude police:

            § 811.540

Fleeing or attempting to elude police officer

            • penalty
            (1) A person commits the crime of fleeing or attempting to elude a police officer if:

            (a) The person is operating a motor vehicle; and

            (b) A police officer who is in uniform and prominently displaying the police officers badge of office or operating a vehicle appropriately marked showing it to be an official police vehicle gives a visual or audible signal to bring the vehicle to a stop, including any signal by hand, voice, emergency light or siren, and either:

            (A) The person, while still in the vehicle, knowingly flees or attempts to elude a pursuing police officer; or

            (B) The person gets out of the vehicle and knowingly flees or attempts to elude the police officer.

            Felony in Idaho

            TITLE 49
            MOTOR VEHICLES
            CHAPTER 14
49-1404. Fleeing or attempting to elude a peace officer — Penalty. (1) Any driver of a motor vehicle who wilfully flees or attempts to elude a pursuing police vehicle when given a visual or audible signal to bring the vehicle to a stop, shall be guilty of a misdemeanor. The signal given by a peace officer may be by emergency lights or siren. The signal given by a peace officer by emergency lights or siren need not conform to the standards for decibel ratings or light visibility specified in section 49-623(3), Idaho Code. It is sufficient proof that a reasonable person knew or should have known that the visual or audible signal given by a peace officer was intended to bring the pursued vehicle to a stop.
            (2) An operator who violates the provisions of subsection (1) and while so doing:
            (a) Travels in excess of thirty (30) miles per hour above the posted speed limit;
            (b) Causes damage to the property of another or bodily injury to another;
            (c) Drives his vehicle in a manner as to endanger or likely to endanger the property of another or the person of another; or
            (d) Leaves the state;
            is guilty of a felony.

          • TNUGA

While you are correct that it is a misdemeanor in TX, it is a felony an many other states. And regardless of whether it’s a misdemeanor or a felony, we are required by law to stop and submit to arrest when told to do so by law enforcement.

            Title XXIII
            MOTOR VEHICLESChapter 316
STATE UNIFORM TRAFFIC CONTROLView Entire Chapter F.S. 316.1935

316.1935 Fleeing or attempting to elude a law enforcement officer; aggravated fleeing or eluding.—(1) It is unlawful for the operator of any vehicle, having knowledge that he or she has been ordered to stop such vehicle by a duly authorized law enforcement officer, willfully to refuse or fail to stop the vehicle in compliance with such order or, having stopped in knowing compliance with such order, willfully to flee in an attempt to elude the officer, and a person who violates this subsection commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Now the onion is being peeled back layer by layer,
It is absolutely clear the Oregon Terrorist Trial, was just Pure Harassment
    of law abiding citizens.
The Murder of LaVoy Finicum is starting to
show/prove Premeditated Murder by the Oregon State Police and the FBI.
(Use of Foam Bullet used to get Lavoy to lower his arms to have an excuse
    to complete the Murder)

    • TNUGA

      Foam Bullet?
You falling for that ruse, TMEG?

      • Silver11

You have been wrong about everything else
involving the Murder of Robert LaVoy Finicum and
the bird preserve in Oregon I wouldn’t expect you to
        Comprehend the Foam Bullet Theory.
Many experienced Law Enforcement Officers ( Active/Retired)
understand what happened, he was intentionally Murdered.
TNUGA, you are always close, but never win the cigar !
Get out of your government cubicle and get some real experience.
(Your Debating Experience is Awesome, but in real life you come
        up seriously lacking))

        • TNUGA

Lol! At least you are persistent, but you havent shown me to be wrong on anything!

Have you even seen the “foam bullet” video?

  • Silver11

Now the onion is being peeled back layer by layer,
the facts about The Oregon Terrorist have shown there was
no Criminal Conspiracy/Felonies that the defendants were guilty of.
Robert LaVoy Finicum was intentionally Murdered by the FBI and
    The Oregon State Police.
As the facts unraveled the reason the Federal Government and why the Progressive
Oregon State’s Communist Politicians set up the arrest of the Bundy Party
    and murder of Finicum.
Government Players Obummer, and Valerie Jared are now history.
May the true enemies of freedom hang!
