Ted Cruz Will Not Compromise on Liberty
This was one of the most important questions and answers of the evening, answered by Senator Ted Cruz on religious liberty, and liberty and the Constitution in general.
The question regarded counterfeit marriage and the adoption of children by homosexuals. Cruz, who has clerked for U.S. Supreme Court Chief Justice William Rehnquist and has argued more cases-successfully-before the U.S. Supreme Court than any Solicitor General in Texas history, rightly pointed out that the U.S. Constitution gives the federal government no authority whatsoever to make decisions regarding marriage and family.
As the enumerated powers of Article 1 Section 8 make clear, the federal government has no authority, no jurisdiction in this area. The Tenth Amendment further makes this crystal clear:
The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.
And as “Father of the Constitution” James Madison again confirms in Federalist No. 45:
The powers delegated by the proposed Constitution to the federal government, are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation, and foreign commerce; with which last the power of taxation will, for the most part, be connected.
Such things are for the states to decide, and before the federal government illegally began to interject itself into the issue, over 40 states spoke very clearly on the matter: marriage can only be formed by a man and a woman.
When we undermine marriage and family, we have undermined the most important institution, the most important building block of any society.
When we allow government to overstep its constitutional bounds, we have spit on the rule of law, and everyone’s liberty in every area is in jeopardy.
Unlike “deal maker” Donald Trump or Marco “Amnesty” Rubio, has a record-not rhetoric, but a record-which proves he will not compromise on important principles of freedom and limited government.
Everyone else on that stage tonight has proven they WILL compromise away constitutional limits on government and the protections for our liberty put in place by our founders.
The verifiable record of Ted Cruz proves he will not.
