Governor, Resist Unlawful Marriage Edicts
The following is a letter I just sent to South Dakota Governor Dennis Daugaard regarding today’s U.S. Supreme Court opinion on counterfeit marriage:
Dear Governor Daugaard:
I read with interest your statement this morning, in light of the U.S. Supreme Court’s opinion on counterfeit marriage, that “the state will follow the law.”
I hope you understand that no new laws authorizing counterfeit marriage have been passed in South Dakota or anywhere else in the United States. Therefore, if South Dakota “follows the law,” there will continue to be no counterfeit marriage in South Dakota.
Because so many people in all levels of our society seem to have forgotten some fundamental truths about the American form of government, please allow me to remind you that under the U.S. Constitution, we have a limited government where the states and the people delegate certain authorities to the federal government. Those are enumerated in Article 1 Section 8 of the U.S. Constitution, and as the Tenth Amendment makes clear, any authority not clearly delegated to the federal government is retained by the states and the people. Nowhere in Article 1 Section 8 or anywhere else in the U.S. Constitution is the federal government given authority to redefine the definition of marriage which every civilization throughout history has recognized takes a man and a woman to form.
What’s more, the U.S. Constitution provides authority for crafting new laws to the legislative branch, not the judicial branch, and those new laws must be signed into law by the executive.
No new bill authorizing counterfeit marriage has been passed by the legislative body of the United States, nor has any such new bill been signed into law by the chief executive.
Also, no new bill authorizing counterfeit marriage has been passed by the legislative body of the state of South Dakota, nor has any such new bill been signed into law by you, the chief executive of South Dakota.
Since the Supreme Court is only authorized by the U.S. Constitution to adjudicate according to EXISTING law, and existing law states that marriage can only be valid between a man and a woman, the opinion rendered by the majority of the U.S. Supreme Court today is of no effect, is meaningless, and actually seeks to contradict existing law and the U.S. Constitution.
Therefore, if South Dakota “will follow the law,” then there will be no counterfeit marriage between homosexuals allowed in the state of South Dakota. To allow counterfeit marriage in the state of South Dakota violates existing law, including the U.S. Constitution and the South Dakota Constitution.
Good people have a duty to resist and refuse to obey illegal edicts. The opinion issued by the U.S. Supreme Court is an illegal edict, and should be ignored by the state of South Dakota.
In this day and age of widespread fecklessness and moral corruption, you have an opportunity to show great and courageous leadership, for the state of South Dakota and for the United States. I hope and pray you will avail yourself of that opportunity and do the right thing, by the law of South Dakota, by the law of the United States, as well as the Laws of Nature and of Nature’s God.

I hope you will consider sending a similar message yourself, to help strengthen the knees of our elected officials in the face of this federal tyranny.
As I said yesterday when I urged our federal representatives to impeach six U.S. Supreme Court justices for their violation of the U.S. Constitution regarding ObamaCare, our elected officials may choose to ignore the truth and ignore their duty to our constitutional republic, but if “we the people” remind them of their duty, they cannot say that they did not know the right thing to do when it has been put in front of their face.
It is our duty as citizens to make sure they cannot use ignorance as an excuse for fecklessness.
